Musimba’s argument;
*IEBC promised that all systems had been tested and working well but they failed.
*KIEMS kits in 84 polling stations in Makueni failed to work despite IEBC promising that they’d work well.
*IEBC did not train its staff on the use of KIEM’S KITS adequately.
*Time taken tallying, announcement and declaration of winner was long.
*There was poor preparation by IEBC on conducting elections. They did not do testing of IEBC Kiem’s kits.
*IEBC failed to give timely information on how to conduct elections in the areas that KIEM’S KITS failed.

-Musimba is thereby asking court to reacount and retabulate the votes of the entire county, nullify the entire election & call for a fresh elections.
To note;
1. In Kibwezi West (Hon. Musimba’s home constituency) Governor Mutula Kilonzo Jr. got 26,390 votes against Musimba’s 25,957 Votes.
2. After IEBC Kiem’s kits failed, IEBC deployed manual voting in the same area and people voted.
3. The Manual register voting was used in all seats from President, Senator, W. Rep, MPs, to MCA. No one in all these seats is complaining of the outcome except Hon. Musimba.
4. Hon. Musimba didn’t have agents in almost all polling stations of Makueni.
5. Case similar to that if AZIMIO Vs IEBC that supreme court termed as ‘hot air’.
